Based on other relevant current legal documents of the State;

As requested by the Trade Union Affairs Committee of the Vietnam General Confederation of Labor.

DECISION

Article 1. The union membership fee will be reduced as follows:

1. Union members in grassroots trade unions of public service units who do not receive 100% of their salary from the state budget: the monthly union fee is 0,5% of the salary used as the basis for mandatory social insurance contributions as stipulated by the law on social insurance.

2. Union members in state-owned enterprise trade unions (including trade unions in state-owned joint-stock companies with controlling stakes): the monthly union fee is 0,5% of the net salary (salary after deducting social insurance, health insurance, unemployment insurance, and personal income tax of the union member), but the maximum monthly union fee is 10% of the basic salary as stipulated by the State.

3. Union members in grassroots trade unions of non-state enterprises (including trade unions of joint-stock companies where the state does not hold a controlling stake); non-public service units; cooperative unions; foreign organizations and international organizations operating in Vietnam; executive offices of foreign parties in business cooperation contracts in Vietnam; union members working abroad: The monthly union dues are 0,5% of the salary used as the basis for compulsory social insurance contributions as prescribed by the law on social insurance, but the maximum monthly union dues are 10% of the basic salary as prescribed by the State.

4. The grassroots trade unions mentioned in Clauses 2 and 3 of this Article may collect monthly union dues from their members at a rate of 0,5% of their net salary (salary after deducting social insurance, health insurance, unemployment insurance, and personal income tax) or a rate higher than 0,5% of the salary used as the basis for social insurance contributions if approved by the expanded Executive Committee of the grassroots trade union (from the union group leader upwards) through a Resolution, in writing, and specifically stipulated in the internal expenditure regulations of the grassroots trade union. Any additional union dues collected beyond the amount stipulated in Clauses 2 and 3 of this Article shall be retained 100% by the grassroots trade union to supplement its operational expenses in accordance with regulations; when reporting the final accounts, the grassroots trade union must separate the additional union dues using the prescribed form to provide a basis for calculating the amount payable to the higher level.

5. Union members in enterprises where it is difficult to determine the salary used as the basis for paying union dues, and union members who are not subject to mandatory social insurance contributions: Pay union dues at the fixed rate, but the minimum contribution is 0,5% of the basic salary as stipulated by the State.

6. Union members receiving social insurance benefits for one month or more are exempt from paying union dues during the benefit period; union members who are unemployed, have no income, or are on leave for one month or more without receiving a salary are also exempt from paying union dues during that period.

Article 2. This Decision takes effect from July 01, 07.

Article 3. The Trade Union Committee will guide and inspect the implementation of this Regulation in trade union organizations.

Article 4. The departments and units under the Vietnam General Confederation of Labor, and all levels of trade unions are responsible for implementing this Decision.
