1. Who is required to participate in compulsory social insurance?

Based on Articles 4, 13, 17, and 21 of Decision 595/QD-BHXH, the subjects required to participate in compulsory social insurance, health insurance, and unemployment insurance are as follows:

Workers who are Vietnamese citizens and are subject to mandatory social insurance include:

Business managers and cooperative managers receive salaries;

– Officials, civil servants, and public employees as defined by the law on officials, civil servants, and public employees;

Employees working under fixed-term employment contracts of 01 month to less than 03 months.;

- Workers under an indefinite-term employment contract, a fixed-term employment contract, a seasonal employment contract, or a contract for a specific job with a duration of at least 03 months but less than 12 months.including employment contracts signed between the employer and the legal representative of a person under 15 years of age as stipulated by labor law;

Note:

For workers who work in two or more places:

+ Social insurance and unemployment insurance contributions based on the first employment contract.

+ The health insurance premium is based on the employment contract with the highest salary.

 Businesses must enroll their employees in social insurance within 30 days of signing the employment contract or work agreement, or the effective date of the recruitment decision.

2. Criminal liability for businesses failing to provide social insurance for their employees.

In 2019, the Vietnam Social Security issued Official Letter No. 530/BHXH-BT regarding the review, exploitation, and control of the development of social insurance participants through data provided by the tax authorities. Simultaneously, it strengthened the organization of surprise specialized inspections of social insurance contributions in 2019.

After receiving data from the tax authorities, the specialized departments of the Social Insurance agencies in provinces and cities require businesses to prepare registration documents for their employees to participate in social insurance; they also urge, guide, inspect, and audit businesses if they fail to register or pay social insurance contributions incompletely or not on time.

After the deadline for businesses to register for social insurance contributions has passed, if the business still fails to do so, within the next 5 days, the social insurance agency will request relevant agencies such as the Provincial/District Police, Tax Department, Planning and Investment Department, state management agencies on labor, and representatives of the People's Committee of the commune, ward, or town where the business is located to coordinate in inviting the business to the social insurance agency for a meeting and requesting them to prepare the necessary documents for social insurance registration as prescribed.

After 10 days from the date of requesting businesses to register for social insurance contributions for their employees, if the business still refuses to pay social insurance contributions, the social insurance agencies of provinces and cities will organize unannounced specialized inspections.

In cases of serious violations by businesses, priority should be given to completing the procedures for transferring the case file to the police for investigation, prosecution, and criminal handling of the crime of evading social insurance contributions.

It is expected that by December 31st at the latest, provincial and city social insurance agencies must complete the review, exploitation, and development of the number of social insurance participants through data provided by the tax authorities. This will be accompanied by inspections of businesses that evaded or underpaid social insurance contributions for employees who were required to participate but evaded contributions from 2019 onwards.

The types of documents that need to be provided to the Social Insurance agency for verification include: employment contracts, time sheets, payrolls, salary scales, labor declarations, salary regulations, internal rules, collective bargaining agreements, trade union documents, etc. These documents must reflect the actual situation.
