The Ho Chi Minh City People's Committee has just issued a document directing relevant agencies to investigate and handle cases of business violations in apartment buildings in the city.
Accordingly, the Department of Construction is responsible for disseminating regulations on the management and use of apartment buildings in Ho Chi Minh City. The People's Committees of districts and communes are responsible for organizing comprehensive inspections, reviews, and handling violations by businesses, branches, representative offices, business locations, and household businesses registered in apartment buildings within their areas. They are also responsible for reviewing the operational status of these businesses, branches, representative offices, and business locations.
Businesses operating in apartment buildings need to relocate their operations to a different location outside of an apartment building. Simultaneously, they must register the change of registered address at the Business Registration Office of the Department of Planning and Investment for businesses, branches, representative offices, and business locations. Household businesses will register the change of registered address at the People's Committee of the district or county.
According to Article 80 of Decree 99 issued in 2015, organizations, households, and individuals must relocate their business activities to a location other than an apartment building within six months from December 10, 2015. After June 10, 2016, households and individuals are no longer allowed to conduct business in apartment buildings.
Article 80. Transitional provisions for housing development and management
In cases where the business registration certificate issued by the competent authority indicates the use of an apartment as a business location before the effective date of the Housing Law, the organization, household, or individual granted this business registration certificate must relocate their business activities to a location other than an apartment within six months from the effective date of this Decree; the competent authority that issued the business registration certificate must adjust the business location recorded in the issued business registration certificate to a different location within the time limit specified in this Clause; after the time limit specified in this Clause, the organization, household, or individual will not be allowed to conduct business in an apartment.
