A science and technology enterprise is an enterprise established and operating in accordance with Vietnamese law, engaged in the production, business, and services derived from scientific and technological results, and granted a science and technology enterprise certificate in accordance with the law.

After establishment, the enterprise prepares an application for certification as a science and technology enterprise and submits it to the local Department of Science and Technology where the enterprise's head office is located for consideration and issuance of a science and technology enterprise certificate.
2. What are the requirements for certification as a science and technology enterprise?
Article 6 of Decree 13/2019/ND-CP stipulates the conditions for granting a Certificate of Science and Technology Enterprise.
1. Enterprises are granted a Certificate of Science and Technology Enterprise when they meet the following conditions:
a) Established and operating in accordance with the Enterprise Law;
b) Capable of generating or applying scientific and technological results that are evaluated, assessed, and recognized by competent authorities in accordance with the provisions of Clause 2, Article 7 of this Decree;
c) Revenue from the production and sale of products resulting from scientific and technological achievements accounts for at least 30% of total revenue.
2. Newly established enterprises less than 5 years old that meet the conditions specified in points a and b of Clause 1 of this Article shall be certified as science and technology enterprises.
3. Procedures and documents for applying for certification as a science and technology enterprise.
Article 7 of Decree 13/2019/ND-CP stipulates: Procedures and documents for requesting certification as a science and technology enterprise.
1. Enterprises meeting the conditions stipulated in Article 6 of this Decree shall submit one set of application documents for certification as a science and technology enterprise to the competent authority as prescribed in Article 5 of this Decree. The documents may be submitted in person, by mail, or online.
2. The application dossier for certification as a science and technology enterprise includes:
a) Request certification as a science and technology enterprise using Form No. 01 in the Appendix attached to this Decree;
b) Documents confirming or recognizing scientific and technological results from competent authorities (copies presented with the original for verification or certified copies), belonging to one of the following documents:
- Intellectual property protection certificate;
- Decisions on recognizing new plant varieties, new animal breeds, new aquatic species, new forestry plant varieties, and technological advancements;
- Certificates of awards for achievements in science and technology awarded by competent state agencies that have organized or approved the awarding of prizes;
- Decision recognizing the results of scientific and technological tasks using state budget funds or Certificate of registration of results of scientific and technological tasks using state budget funds; Confirmation or assessment certificate of results of scientific and technological tasks not using state budget funds;
- Certificate of registration for technology transfer;
- Other documents confirming or recognizing the document have equivalent legal validity.
c) Production and business plan for products resulting from scientific and technological achievements, using Form No. 02 in the Appendix attached to this Decree.
4. The Value of the Science and Technology Enterprise Certificate
1. The Science and Technology Enterprise Certificate serves as the basis for implementing preferential policies and support for science and technology enterprises and is valid nationwide.
2. The Certificate of Science and Technology Enterprise also serves as the Certificate of Registration for Science and Technology Activities.
3. The certificate of science and technology enterprise serves as the basis for applying investment incentives to science and technology enterprises.
