How do workers with multiple employment contracts participate in mandatory social insurance?

1. Can an employee sign multiple employment contracts?

According to Article 19 Labor Code 2019Workers are allowed to enter into multiple employment contracts with different businesses, provided they fulfill all obligations under each contract.

2. So how do I participate in social insurance if I work in multiple places?

According to Clause 5, Article 2 Social Insurance Law 2024 and Clause 5 of Article 13 Law on Health Insurance 2024:

  • If an employee enters into multiple employment contracts at the same time, then... Only participate in mandatory social insurance and health insurance at the first contract..
  • If the first contract is temporarily suspended, and there is no agreement to pay social insurance during the suspension period, then the next valid contract will be used as the basis.

Based on Clause 1, Article 31 Social Insurance Law 2024The salary used for calculating social insurance contributions includes:

  • Salary based on job or position;
  • Salary allowance;
  • Other additional payments regular, stable in each pay period.
