1. The worker is a Vietnamese citizen.
Workers who are Vietnamese citizens and are subject to mandatory social insurance include:
a) Persons working under indefinite-term employment contracts, fixed-term employment contracts, seasonal employment contracts, or contracts for a specific job with a duration of at least 03 months but less than 12 months, including employment contracts signed between the employer and the legal representative of a person under 15 years of age as stipulated by labor law;
b) Persons working under labor contracts with a term of between full 6 months and under months of months;
c) Officials, civil servants, and public employees;
d) Defense workers, public security workers, and other personnel working in cryptographic organizations;
e) Officers and professional soldiers of the People's Army; officers, non-commissioned officers, and technical specialists of the People's Public Security; and personnel working in cryptography who receive salaries equivalent to those of military personnel;
f) Non-commissioned officers and soldiers of the People's Army; non-commissioned officers and soldiers of the People's Public Security serving for a fixed term; military, police, and intelligence trainees currently studying are entitled to living allowances;
g) Persons working abroad under contracts as stipulated in the Law on Vietnamese workers working abroad under contracts;
h) Business managers and cooperative managers who receive salaries;
i) Non-professional personnel working at the commune, ward, or town level.
4. Individuals participating in voluntary social insurance are Vietnamese citizens aged 15 years and older who do not fall under the categories specified in Clause 1 of this Article.
5. Agencies, organizations, and individuals involved in social insurance.
The subjects specified in Clauses 1, 2 and 4 of this Article are hereinafter collectively referred to as employees.
2. Workers who are foreign citizens.
Employees who are foreign citizens working in Vietnam with a work permit or a practice certificate or a practice license issued by a competent Vietnamese agency are entitled to participate in compulsory social insurance according to regulations. regulations of the Government.
3. Other subjects
- Employers participating in compulsory social insurance include state agencies, public service units, people's armed forces units; political organizations, socio-political organizations, socio-professional organizations, social-professional organizations, and other social organizations; foreign agencies and organizations, and international organizations operating in Vietnam; enterprises, cooperatives, individual business households, partnerships, other organizations, and individuals who hire and employ workers under labor contracts.
Individuals eligible for voluntary social insurance are Vietnamese citizens aged 15 years and older who do not fall under the categories specified in Clause 1 of this Article.
