Husbands are entitled to maternity benefits when their wives give birth, starting from July 1, 2019.

According to the Social Insurance Law of 2014, male workers participating in social insurance whose wives give birth are also entitled to maternity benefits, not just female workers. From July 1, 2019, when a wife gives birth, the husband receives a one-time maternity allowance of nearly 3 million VND based on the increased base salary.

REGULATIONS REGARDING HUSBANDS RECEIVING MATERNITY BENEFITS

According to Article 38 of the 2014 Social Insurance Law, when a wife gives birth but only the husband participates in social insurance contributions, the husband will receive a one-time allowance equal to twice the basic salary in the month the wife gives birth for each child.

From July 1st, 2019, husbands will receive a maternity allowance of 2,98 million VND per month; an increase of 200.000 VND compared to before due to the increase in the basic salary to 1,49 million VND per month.

Conditions for a husband to be eligible for maternity benefits: To be eligible for a one-time maternity benefit, the husband must have paid social insurance contributions for at least 6 months within the 12 months preceding his wife's childbirth.

How many days off is a husband entitled to when his wife gives birth?

In addition to receiving benefits, husbands are also entitled to paid leave when their wives give birth. Specifically, the number of days of leave is as follows:

– Take 5 days off if your wife gives birth naturally.

– 7 working days when the wife gives birth via C-section or gives birth to a child under 32 weeks old.

– 10 working days when wife gives birth to twins

– For triplets or more, an additional 3 working days of leave are granted for each additional child.

– If the wife gives birth to twins or more and requires surgery, she is entitled to 14 working days of leave.

The leave period for maternity benefits specified in this Clause shall be calculated within the period of 30 days from the first day of the wife's birth.

In cases where both husband and wife participate in social insurance, or only the wife participates in social insurance and the wife dies after giving birth, the husband is entitled to maternity leave benefits for the remaining period of the wife's leave.

If the wife participates in social insurance but does not meet the eligibility requirements regarding the duration of social insurance contributions and dies, or if only the husband participates in social insurance and the wife dies after giving birth or experiences a post-natal complication that renders her unable to care for the child, as confirmed by a medical facility, then the husband is entitled to maternity leave until the child reaches 6 months of age.
